These Terms of Service ("Terms") govern your use of the MemoirAI service operated by Magpie AI LLC ("we," "us," "our"). By using MemoirAI, you agree to these Terms. If you do not agree, please do not use the service.
MemoirAI is a phone-based service that helps you preserve your life stories. You call a dedicated phone number, speak with an AI assistant, and your stories are compiled into a written memoir that you can read and share with family and friends.
MemoirAI is intended for users who are 18 years of age or older. By using the service, you represent that you are at least 18 years old. If we learn that a user is under 18, we will terminate their access and delete their data.
All calls to MemoirAI are recorded and transcribed using AI technology in order to create your memoir. You are informed of this at the beginning of each call. By continuing a call after this notification, you consent to the recording and transcription of that call. If you do not consent, you should hang up immediately.
When your memoir is ready or when we have service-related updates, we may send SMS messages to the phone number you called from.
You retain ownership of the stories you share with MemoirAI. By using the service, you grant us a limited, non-exclusive license to record, transcribe, store, and process your conversations for the sole purpose of creating and delivering your memoir.
Memoirs are generated by artificial intelligence based on your conversations. While we strive for accuracy, AI-generated content may contain errors, misinterpretations, or inaccuracies. You are encouraged to review your memoir and contact us if corrections are needed. MemoirAI is not a substitute for professional memoir writing, legal documentation, or any form of official record.
You may access MemoirAI through an organization (such as a senior living community, employer, or other group) that has purchased the service on your behalf. In this case, the organization's purchase enables your access but does not change your rights under these Terms. The organization does not have access to your stories, transcripts, memoir content, or any personal information you share with MemoirAI. Your relationship with MemoirAI is governed by these Terms and our Privacy Policy, regardless of how you were introduced to the service.
MemoirAI is intended for personal storytelling. You agree not to use the service for any unlawful purpose or to share content that is harmful, threatening, abusive, or that violates the rights of others.
You may stop using MemoirAI at any time. You may also request deletion of your data at any time by contacting us, as described in our Privacy Policy. We reserve the right to suspend or terminate your access to the service if we reasonably believe you have violated these Terms, without prior notice.
We provide MemoirAI on an "as is" and "as available" basis, without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees about the availability, reliability, or accuracy of the service. We may modify, suspend, or discontinue the service at any time without notice.
To the maximum extent permitted by law, Magpie AI LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to inaccuracies in memoir content, loss of story data, or service interruptions.
Our total liability to you for any direct damages arising from or related to the service shall not exceed the amount you personally paid to us for use of the service in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
You agree to indemnify and hold harmless Magpie AI LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or any content you provide through the service that infringes or violates the rights of a third party.
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the service shall be resolved in the state or federal courts located in Illinois.
Your use of MemoirAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the service, you acknowledge that you have read and understood the Privacy Policy.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. If we make material changes, we will make reasonable efforts to notify you. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.
