MemoirAI is a service of Magpie AI LLC ("we," "us," "our"). MemoirAI is a phone-based service that helps people preserve their life stories as written memoirs. This Privacy Policy describes what information we collect, how we use it, who may have access to it, and your rights regarding that information.

Information We Collect

When you use MemoirAI, we collect:

• Phone number — captured automatically when you call our service. Used to identify you on return calls and to send you SMS notifications related to the service.
• Call recordings and transcripts — your conversations with our AI assistant are recorded and transcribed to create your memoir. You are informed at the beginning of each call that the conversation is being recorded, and by continuing the call you consent to the recording.
• Personal details shared during conversations — if you share information such as your name, birthday, birthplace, or other personal details during a call, we store them to personalize your memoir.

How We Use Your Information

We use the information we collect solely to provide and improve the MemoirAI service:

• To recognize you when you call back and recall your previous stories
• To create a written memoir from your conversations
• To send you SMS notifications related to the service, such as a link to your completed memoir

We do not sell your information. We do not use your stories or personal information for advertising or marketing purposes.

SMS Communications

By using MemoirAI, you consent to receive SMS messages at the phone number you provide. Messages are limited in frequency and relate only to the delivery of your memoir or service updates. Message and data rates may apply. You may opt out of SMS messages at any time by replying STOP to any message from us. Reply HELP for assistance.

Group and Organizational Access

MemoirAI may be offered to you through an organization such as a senior living community, employer, or other group purchaser. In these cases, the organization may provide us with your phone number or other contact information to enable the service. However, the organization does not have access to your stories, transcripts, memoir content, or any other personal information you share with MemoirAI. We may share only anonymized, aggregate usage statistics with the organization — such as the number of participants who used the service and total minutes of engagement. These statistics cannot be used to identify any individual user.

Third-Party Service Providers

To operate MemoirAI, we use a limited number of third-party service providers in the following categories: telephony and voice processing, AI and language processing, SMS delivery, and cloud hosting. These providers process your data solely on our behalf and under our instructions to deliver the MemoirAI service. We do not share your personal information with any third parties for their own independent use.

Data Retention

We retain your stories, transcripts, and memoir for as long as your account is active or as needed to provide the service. This allows you to continue adding to your memoir over time. If you have not interacted with MemoirAI for 24 months, we may contact you before removing your data. You may request deletion of your data at any time by contacting us (see below), and we will remove all of your information from our systems within 30 days of your request.

Data Security

We take reasonable measures to protect your information, including encrypted connections (HTTPS) for all data in transit and access controls on our database and internal systems. However, no method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security.

Data Breach Notification

In the unlikely event of a data breach affecting your personal information, we will notify affected users and any applicable regulatory authorities as required by law, and will do so as promptly as reasonably possible.

Legal Basis for Processing

We process your personal information on the following bases: your consent (provided when you choose to call and use the service, and when you continue a call after being informed it is recorded); the necessity of processing to perform the service you have requested; and our legitimate interest in operating, maintaining, and improving MemoirAI.

Your Rights

Depending on your jurisdiction, you may have the right to:

• Request a copy of the personal data we hold about you
• Request correction of inaccurate data
• Request that we delete all of your data
• Opt out of SMS messages by replying STOP to any message from us

Children's Privacy

MemoirAI is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected information from a person under 18, we will take steps to delete that information promptly.

Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated effective date. If we make material changes that affect how we handle your personal information, we will make reasonable efforts to notify you.
